These Terms of Service ("Terms") govern your use of the Diet Match mobile application and related services (the "Service"), provided by ETECHFLOW LTD ("we", "us", "our"), a company registered in England and Wales, registered office in Wolverhampton, United Kingdom (company number: 17286927). By creating an account or using the Service, you agree to these Terms.
You must be at least 16 years old to use Diet Match. By using the Service, you confirm you meet this requirement and that any health or diet information you provide is accurate to the best of your knowledge.
Diet Match provides meal planning, recipe suggestions, grocery lists, a food/menu compliance scanner (Premium+), and a symptom journal, generated against dietary restrictions you tell us about. The Service is offered on a freemium basis across Free, Premium, and Premium+ tiers, described in the App and on our store listings.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised use.
Premium and Premium+ are auto-renewing subscriptions billed through the Apple App Store or Google Play, at the price shown at purchase.
Free trials, where offered, convert automatically to a paid subscription at the end of the trial period unless cancelled before it ends.
You can cancel at any time through your Apple ID or Google Play account settings; cancellation takes effect at the end of the current billing period, and we do not provide partial refunds for unused time, except where required by law or by Apple's/Google's own refund policies.
We may change subscription prices; for existing subscribers, changes take effect no earlier than your next renewal and, where required, we or the platform will notify you in advance.
You agree not to: misuse the Service to harm others; attempt to reverse-engineer, scrape, or interfere with the Service; provide false health information with intent to circumvent tier limits; or use the Service in any way that violates applicable law.
This clause is the single most important piece of legal risk-management in this document. The wording below reflects the required Google Play health-content disclaimer language plus additional protective language, but MUST be reviewed and, if necessary, strengthened by a solicitor and the dietitian reviewer referenced in the Launch Specification before publication.
Diet Match is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. The App is intended as a general planning and informational tool to help you organise meals around dietary restrictions you specify — it is not a substitute for professional medical, dietetic, or nutritional advice, diagnosis, or treatment.
Always consult a qualified physician, nephrologist, dietitian, or other appropriate healthcare professional before making changes to your diet, particularly if you manage a serious condition such as chronic kidney disease or diabetes.
Never disregard professional medical advice or delay seeking it because of something you read or were shown in the App.
The App's recipe compliance scores, scanner verdicts, and meal plans are generated from public nutrient databases and encoded dietary rules; while we take reasonable care, including a dietitian review of the underlying rules (see our Launch Specification), we cannot guarantee they are error-free or appropriate for your specific medical circumstances.
If you have a food emergency or a severe allergic reaction, contact emergency services immediately — do not rely on the App.
By using the Service, you acknowledge and accept the limitations described in this section.
The Service, including its software, design, and content (excluding content from third-party data sources such as USDA FoodData Central, which remains subject to its own terms), is owned by ETECHFLOW LTD or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the App for your personal, non-commercial use.
The Service relies on third-party platforms and data sources, including Apple App Store, Google Play, and USDA FoodData Central. Your use of those platforms is also subject to their own terms. We are not responsible for the availability or accuracy of third-party services outside our control.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Nothing in this section limits any statutory rights you have as a consumer that cannot lawfully be excluded.
To the fullest extent permitted by law, ETECHFLOW LTD shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited under English law. Subject to the preceding sentence, our total liability to you for all claims arising out of or relating to the Service in any twelve-month period shall not exceed the total amount you paid us for the Service during that period (or, if you have paid nothing, GBP 50). This limitation does not affect your statutory rights as a consumer under English law, which cannot be waived.
You agree to indemnify and hold ETECHFLOW LTD harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, with notice where reasonably practicable.
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Service is subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections available to you in your country of residence.
We may update these Terms from time to time. Material changes will be notified in the App or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
